Gestational surrogacy is legal in India and supported by the Indian government that is currently making further steps to ensure all sides of this process are smooth and favorable to all parties involved.

A baby carried by a gestational surrogate mother has no genetic relation to her. The biological parents eggs and sperm sample are used to create embryos that are later transferred to the surrogate mother's uterus. When the biological mother or father cannot provide their own material for the surrogacy program, an egg or sperm donor is used.* One of the Intended Parents must legally be genetically linked to the baby, therefore both an egg and sperm donor cannot be used when proceeding with surrogacy.


All the surrogate mothers approved for our program are healthy, do not drink, smoke or take drugs, are between 18 and 35 years old and have at least one healthy child of their own.

 

If the surrogate mother is married when she participates in the surrogacy program, her husband signs a written, notarized consent, where he agrees that his wife takes part in the surrogacy program. He acknowledges that she has his support and he will not have any claims for the paternity of the child delivered by the surrogate mother.

 

 

We are able to provide single/divorced/widowed surrogates for those parents who legally require that their surrogate is not married.

 

The biological parent/s sign a contract with the surrogate mother, and are directly in charge of her monthly fees for food, transportation expenses during the program and her final compensation at the end of the program.These costs are clearly disclosed in both your payment schedule and contract.

 

Traditional surrogacy is where the surrogate mother uses her own eggs and is therefore the genetic mother of the baby. Traditional surrogacy is not permitted or practiced by any of the New Life network centers and clinics.
